El 2004 se lanza el informe de desarrollo humano donde nos alertan sobre la realidad de la niñez y adolescencia en Bolivia. Resulta que este segmento poblacional -en términos estadísticos- corresponde casi al 50% de la población boliviana. La etapa en el crecimiento poblacional boliviano se denomina bono demográfico, lo que puede repercutir positivamente en la economía.
Un gran porcentaje de la población económicamente activa, en términos más sencillos una gran cantidad de trabajadores. Lo que en teoría afecta positivamente en la dinamización de la economía, se ensancha el universo de consumidores, incrementando la producción y los salarios.
La nueva constitución expresa muchos derechos a favor de la niñez y en una sana intención –creo yo- se prohíbe el trabajo infantil. En los derechos políticos establece la edad para votar a los 16 y para ser elegido a los 18, un gran avance si tomamos en cuenta que su participación es importante. ¿ es un efecto positivo la participación de los jóvenes en la vida política? ¿Qué pasaría si se les restringe la participación entre la población económicamente activa?
Sabemos de casos extremos del trabajo infantil en todo el mundo, Bolivia en la estructura mundial no es la excepción. Vemos en trabajo de los niños ayudando a las palliris en las minas, los niños que van a la zafra con sus padres, en las ciudades en los semáforos. Por eso digo es una sana intención, pero me queda la incógnita si seria aplicable una legislación que prohíba el trabajo infantil.
Algo más, si la nueva constitución nos otorga la ciudadanía desde el nacimiento. Esta ciudadanía incluye también los derechos laborales, garantizados por el estado. Acaso no es una contradicción que un importante sector de la población económicamente activa quede en la ilegalidad. Contando la importancia que representa este segmento poblacional ¿Quedaran marginados en sus derechos? ¿Se debe penalizar el trabajo infantil?

Estimado, estás confundiendo a los lectores de tu blog, una cosa es el derecho laboral y otra la explotación laboral, no se trata de penalizar el derecho al trabajo, lo que debería estar prohibido es el uso deshonesto de menores de edad para trabajar y recibir utilidades por ello. Al revisar tu gráfica me doy cuenta que la mayoría de los índices corresponden a delitos flagrantes como tráfico de menores, reclutamiento para fines bélicos, prostitución, etc.
La legalidad estaría enmarcada en el derecho del menor (entre los 16 y 18 años, edad considerable para mí) a elegir bajo su responsabilidad el horario y lugar de trabajo, con el fin de tener su propio poder adquisitivo o dinero.
Aclaro, el uso deshonesto de menores de edad para trabajar en actividades ilegales que dan enormes utilidades como guerras, pornografía, prostitución, narcotráfico, etc.
Bueno lo que digo es solamente una reflexion, no me parece correcto juzgar emocionalmente. No puedes decir que el trabajo para un niño es malo, ademas no es una teoria mia; es la realidad en el area rural. Pues la unidad economica es la familia, donde participan todos en la produccion.
En los casos que se refiere a guerras y prostitucion, estoy de acuerdo en su prohibicion. El problema creo que radica en que un gran porcentaje de la poblacion boliviana esta por debajo de los 16 o 18 años, sumado a otro gran porcentaje que sale del pais; disminuye la poblacion en edad de tebajar. ¿quienes van a trabajar entonces? ¿los de la asamblea plurinacional? Queda otra duda sobre el cumplimiento de la ley.

Quien haya publicado la entrada tiene que estar seguro de lo que dice, no por la veracidad, sino por la coherencia, mi comentario es simplemente lógico.
Se supone que el artículo que prohibe el trabajo infantil radica en la protección que se debería otorgar al menor, en castellano, NINGUN MENOR DE EDAD EN BOLIVIA DEBE TRABAJAR. Ahora la necesidad hace que un menor empiece a buscarse la vida para sustentar la suya o la de su familia. Otro es el cantar de quien contrata al menor y lo explota en actividades ilícitas. Espero me entiendan ahora.
Segundo, cuando vos preguntas ¿quienes van a trabajar?, bueno hay personas trabajando en este momento, porque sino nos morimos de hambre y el pais se va a la mierda.
Definitivamente en lo unico que acertás es en indicar que quienes deberían trabajar son los asambleistas, diputados, senadores, etc....

Estimado Chulupi, no es mi lado humano, la ley es clara en su enunciado, ahora que no se cumpla ley bueno, como vos decis, nadie vive de leyes.
La migraciòn es el factor económico màs fuerte de un paìs, tanto el que recibe migrantes como fuerza laboral como los que van y mandan remesas hacia su paìs de origen, en este caso mayores de 18 años.

En esa lògica y debì haber incluido esto antes, es la figura de los padres (sean del campo o ciudad), quienes estàn en la obligaciòn junto al estado de dar protecciòn a ese menor y uno de esos mecanismos de protección es la prohibición del trabajo.
Para un mayor entendimiento, todos los individuos alcanzan la mayorìa de edad a los 18 años, es decir llegan a tener màs deberes que derechos a partir de esa edad, un ejemplo claro es que estàn sujetos a responder judicialmente al estado. Un menor de 18 años, tiene màs derechos por la condiciòn de su edad. Entonces esa prohibiciòn de trabajo infantil es la base de para el cumplimiento de ese derecho.
